Agreement to Terms
By accessing or using the services ("Services") of Apex Sterling LLC, DBA "Apex Jiu Jitsu & MMA", including our website, classes, membership programs, and communications, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
Description of Services
We provide martial arts training (Brazilian Jiu Jitsu, Boxing, Kickboxing, Muay Thai, MMA, and Wrestling), membership management, class scheduling, SMS/text message communications, and related fitness services.
Membership & Registration
Eligibility
You must be at least 18 years old to register for an adult membership. Minors may participate in our programs with parental or guardian consent and registration.
Registration
You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
SMS/Text Messaging Terms
Enrollment
By providing your phone number and opting in, you authorize us to send SMS/text messages to that number. You represent that you are the account holder or have authorization to receive messages at the provided number. You must be 18 years of age or older to enroll in our SMS/text messaging program. If you are under 18, you may not opt in to receive text messages from us.
Message Content
Messages may include appointment reminders and confirmations, class schedules and updates, account notifications, promotional offers (you can opt out), and service-related communications.
Message Frequency
Message frequency varies based on your activity and preferences. You may receive multiple messages per week depending on your engagement with our services.
Costs
Standard message and data rates apply. Check with your mobile carrier for details. We are not responsible for carrier charges.
Opt-Out
To stop receiving messages, reply STOP to any message, contact us by phone or email, or update your account preferences. You may receive a final confirmation message after opting out.

Supported Carriers
Our SMS service is supported by all major U.S. carriers. Availability may vary by location.
Carrier Liability
Carriers (including but not limited to T-Mobile, AT&T, Verizon, and others) are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission by your mobile carrier and is outside of our control.
Mobile Information Sharing
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Payment Terms
Fees
Membership fees and class rates are as stated at the time of enrollment. All fees are non-refundable unless otherwise stated or required by law.
Billing
By providing payment information, you authorize us to charge the specified fees. Recurring charges will continue until you cancel according to our cancellation policy.
Failed Payments
If payment fails, we may suspend your access to Services until payment is resolved. We reserve the right to charge late fees as specified in your membership agreement.
Assumption of Risk & Liability Waiver
Martial arts training involves inherent risks of physical injury. By participating in our programs, you acknowledge these risks and voluntarily assume them. You agree to release and hold harmless Apex Jiu Jitsu & MMA, its owners, coaches, and staff from any claims arising from your participation in our programs.
A separate waiver and release form must be signed before participating in any classes.
Code of Conduct
All members and visitors are expected to:
- Treat coaches, staff, and fellow students with respect
- Maintain proper hygiene and wear clean training attire
- Follow safety rules and coach instructions at all times
- Report injuries or safety concerns immediately
- Not engage in unsanctioned sparring or dangerous behavior
Violation of the code of conduct may result in suspension or termination of membership without refund.
Cancellation
You may cancel your membership according to the cancellation policy outlined in your membership agreement. Cancellations generally require 30 days written notice. Refunds are issued according to our refund policy.
Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Apex Jiu Jitsu & MMA and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.
Limitation of Liability
To the maximum extent permitted by law, Apex Jiu Jitsu & MMA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Loudoun County, Virginia.
Changes to These Terms
We may update these Terms periodically. We will notify you of significant changes by posting the updated terms on our website. Continued use of our Services after changes constitutes acceptance of the updated Terms.
